Passive House Certification Package Agreement

All amounts are expressed in Australian Dollars (AUD) and exclude GST. A 10 % Goods and Services Tax (GST) will be added during the booking process for Australian residents.

Please read this Agreement carefully before purchasing a Passive House Certification Package.

1. Interpretation and Definitions

Account – a unique login to the Learning Platform.

Company – SMART PLUS FAMILY PTY LTD (ABN 36 644 265 412) trading as Passivhaus HUB, 70/35 Hastings St, Scarborough WA 6019, Australia ("we", "us", "our").

Course – any course described on passivhaushub.com or my.passivhaushub.com.

Package – a Passive House Certification Package purchased from the Company (one‑off or instalment plan).

Certification Course – the official Passive House Designer or Tradesperson course delivered by the Company.

Certification Exam – the exam administered for the Passive House Institute (PHI).

Service – the Website and Learning Platform together.

You – the purchaser and participant, or the legal entity you represent.

2. Tuition Information

You agree to pay the tuition published for the Package selected. The Package includes:

• 30‑day advance access to preparatory materials and printable course notes;
• live or recorded Certification Course sessions and recordings for the advertised period;
• 90‑day access to exam‑preparation materials, mock exams and solutions;
• one (1) licence key for PHPP (Designer Packages only). The licence key will be released only after your tuition has been paid in full.
• up to three (3) Certification Exam attempts under the conditions in clause 5;
• membership of a private online support community.

Travel, accommodation and meals for in‑person events are at your own cost. Access is granted only after full payment (or agreed payment plan) and acceptance of this Agreement.

3. Contract Term and Transfer

A. Completion Window

You have twelve (12) months from purchase to:

• complete the Certification Course; and
• undertake your first Certification Exam attempt.

Failure to do so entitles the Company to terminate the Agreement and retain all tuition paid.

B. Transfer to Another Person

You may transfer your enrolment to another person once, free of charge, by emailing us at least 14 days before the Course start date.

C. Transfer to Another Date

You may defer to a later course date once, subject to availability and the following transfer‑fee schedule:

≤ 15 days	AUD 500

The new date must commence within 12 months of the original start date.

4. Payment

All prices displayed exclude GST; a 10 % GST will be calculated and added at checkout for Australian customers.

Full tuition must be received within 10 business days of purchase unless an instalment plan is agreed. Late payment may void any discounts. Instalment plans incur an administration fee shown at checkout.

You must have settled the entire tuition balance (including any instalment‑plan payments) before your first Certification Exam attempt. Exam bookings with an outstanding balance will be cancelled and may attract a rescheduling fee. The PHPP licence key (where applicable) will not be issued until full payment is received.

5. Guarantees

A. Satisfaction Guarantee

If, within seven (7) calendar days of purchase or before completing the first module (whichever occurs first), you email [email protected] requesting a refund, we will refund 100 % of tuition and revoke access.

B. Certification Guarantee

Provided you:

• achieve ≥ 80 % on every Package quiz,
• attend or view every session, and
• attempt your first exam within 12 months of purchase,

you may take up to three (3) exam attempts during that 12‑month period at no extra cost. No refunds are payable if you do not pass after the third attempt.

6. Default, Cancellation & Damages

Non‑payment places you in default; access will be revoked and a non‑refundable damages fee of AUD 995 will be charged. If a PHPP licence key has already been issued, its retail price will also be charged.

7. General Provisions

• Governing law – Western Australia, Australia. Disputes are subject to WA courts, without prejudice to mandatory consumer rights in your jurisdiction.
• No recording – You must not record or publish any part of the Course without written consent.
• Intellectual property – All materials remain the Company’s copyright; personal use only.
• Privacy – Participation may be recorded; see our Privacy Policy.
• Changes – Dates, times and structure may change; reasonable notice will be provided.
