Terms & Conditions – Passivhaus HUB

Terms of Service

This document explains your rights and obligations when you use any Passivhaus HUB website or service. It does not limit consumer rights that cannot be excluded under law.

1. Interpretation & Definitions

Key words used in these Terms.

Company – SMART PLUS FAMILY PTY LTD (ABN 36 644 265 412) trading as Passivhaus HUB, 70/35 Hastings St, Scarborough WA 6019, Australia.
Account – a user profile enabling access to the Service.
Service – the websites passivhaushub.com, my.passivhaushub.com, related sub‑domains and all content or products we supply.
Country – Western Australia, Australia.
Subscription – paid, automatically‑renewing access to all or part of the Service.
You – the individual or entity using the Service.

2. Acceptance

By creating an Account, ticking an “I agree” box or otherwise using the Service you accept these Terms and our Privacy Policy.

If you purchase a Passive House Certification Package, the Certification Package Agreement will apply in addition to these Terms.

3. Prices & Payments

Prices are in Australian Dollars (AUD) and exclude GST. A 10 % GST is added at checkout for Australian customers.
Accepted payment methods are displayed at checkout. Card payments are subject to authorisation.
Subscriptions renew automatically under the same terms. Reminder emails are sent at least 7 days before each renewal. You can cancel any time before the renewal date from your Account or by emailing us.
If you choose an instalment plan, the full balance must be paid before you book an exam or receive a PHPP licence key.
Currency‑conversion fees charged by your bank are your responsibility.

4. Orders, Refunds & Consumer Rights

Your purchase is an offer to buy; we may decline or cancel for fraud, error or other legitimate reasons.
Our Refund & Transfer Policy explains when refunds are available.
EU/UK digital‑content cooling‑off: If you live in the EU or United Kingdom you have 14 days to cancel a digital purchase unless you tick the box for immediate access and acknowledge the right is lost.
Australian Consumer Law (ACL): Our goods and services come with guarantees that cannot be excluded under the ACL. Where permitted, our liability is limited to resupplying the services or paying the cost of resupply.

5. Accounts & Security

You must provide accurate information and keep your password confidential.
You are responsible for all activity that occurs under your Account.
Notify us immediately of unauthorised use.

6. User Content

You grant us a worldwide, royalty‑free licence to use and display Content you upload so we can operate and promote the Service. Do not post illegal, infringing or offensive material—we may remove it and suspend your Account.

7. Intellectual Property & Recording

The Service and its original content are © Passivhaus HUB or licensors. No part may be recorded or redistributed without written consent.

8. Cookies & Privacy

By using the Service you consent to the placement of cookies as described in our Cookie Policy.

9. “AS IS” Disclaimer

The Service is provided “as is” and “as available.” We make no warranties that it will be uninterrupted or error‑free.

10. Limitation of Liability

To the extent allowed by law, our total liability for any claim arising out of the Service is limited to the greater of (a) the amount you paid us in the previous 12 months, or (b) AUD 100. We are not liable for indirect or consequential loss. This clause operates subject to the non‑excludable ACL guarantees referenced in section 4.

11. Accessibility Commitment

We are working towards WCAG 2.2 AA conformance and welcome feedback to improve accessibility.

12. Governing Law & Disputes

These Terms are governed by the laws of Western Australia. If a dispute arises, contact us first. If unresolved, the courts of Western Australia have jurisdiction, except where consumer laws in your country apply mandatorily.

13. Changes to Terms

We may amend these Terms; material changes will be announced on the Website at least 30 days before taking effect. Continued use after that date constitutes acceptance.
